BOARD OF HEALTH MINUTES OF SPECIAL MEETING
June 9, 2009
7:00 pm – 7:33 pm
Members Present: Pat McDonnell, Jodie Buehler and Rosemary Tobin.
Others Present: Jeff Sherman, Floyd County Sanitarian, and Dean Stewart, Realtor.
Members Absent: Dr. Lisa Kapler and Gaylon Hicok.
Meeting called to order at 7:00 pm by Pat McDonnell.
Agenda approved with amendment that the Minutes from the May 11th, 2009, Meeting shall be reviewed at the next Board of Health Meeting along with the Minutes from this Special Meeting. Motion made by Jodie Buehler, second by Rosemary Tobin. Motion carried.
Jeff Sherman – Floyd County Sanitarian
A: Time of Transfer Inspection Ordinance Review – A copy of the revised Floyd County Ordinance 137 reflecting the new Time of Transfer Septic Inspection Law was presented to the Board for their review. Discussion was held concerning the time frame for a person to replace a nonfunctioning septic system and the requirement that a person would have to hook into a public sewer system if one were to become available within 200 feet of their property, as well as the time frame to require a person to hook into same. It was determined that no time frame would be set to replace a nonfunctioning system or to hook into a public sewer system if one were to become available, as there are too many variables that could interfere with a set time frame. Discussion was held concerning the tearing down of a building as being an exemption for a time of transfer inspection. The Board was curious as to what would happen if a person purchases a property and does not immediately tear down the building but has plans to tear it down sometime in the future. Jeff Sherman, Sanitarian, advised the Board that it would have to state in the purchase agreement that they would be tearing down the building served by the septic system. Additionally, there is a document that would need to be signed by both the Buyer and Seller at the time of transfer and recorded with the County Recorder in order to be exempt from a time of transfer inspection. Discussion was held concerning the coursework required to become a certified time of transfer inspector. Jeff Sherman, Sanitarian, clarified that the specific class that was named in the Ordinance is an actual class offered by DMACC.
Discussion was also held concerning the number of certified inspectors. As of this date, Curt Brandau is the only other certified time of transfer inspector in the County. Discussion was also held concerning what Jeff Sherman would charge to do a time of transfer inspection. Jeff indicated that it would be up to the Board of Supervisors, but based on discussions with other County Sanitarians, he would suggest a $250.00 fee. Jeff also clarified that any fees he received would go to the County, any fees that Curt Brandau would receive would go to him, and Jeff would obtain a copy of all inspection reports done within the County and he would ultimately have the final say as to whether the system passes the inspection or whether it needs to be updated in some way or another. Motion to approve the revisions to Floyd County Ordinance 137 with additional changes by the Board during the meeting was made by Rosemary Tobin, second by Jodie Buehler. Motion carried.
B. Contractor’s Licensing Procedure - A copy of the Procedures developed by the Floyd County Sanitarian for Contractor’s Licensing was provided to the Board. Chair Pat McDonnell signed same.
C. Septic Installation Procedure – A copy of the revised Procedures developed by the Floyd County Sanitarian for Septic Installation was provided to the Board, which reflects the new time of transfer inspections. Chair Pat McDonnell signed same.
D. Nuisance Procedure – A copy of the revised Procedures developed by the Floyd County Sanitarian for Nuisances was provided to the Board. Chair Pat McDonnell signed same.

New Business: No new business to discuss.
Next meeting will be held on Monday, July 13th at 7:00 p.m., in the Assembly Room of the Floyd County Courthouse.
