Floyd County Board of Supervisors Meeting

July 11, 2006, 9:00 AM


The Floyd County Board of Supervisors met for regular session at 9:00 a.m. on Tuesday, July 11, 2006 in the Board Room of the Floyd County Courthouse with the following in attendance:  Chairman Staudt, Supv. Dunkel, and Supv. Enabnit.

Enabnit/Dunkel moved to amend the agenda to include discussion on MidAmerican Energy proposal to go through Maple Heights and 195th St. and include discussion on June 26th cut cable update.  Motion carried 3-0.  Dunkel/Enabnit moved to approve the agenda as amended.  Motion carried 3-0.

Moved to amend the June 27th meeting minutes to correct the approval of May, not April, 12, 13, and 19th minutes and correct City Attorney’s name to Ralph Smith and approve the June 27 minutes as amended and the June 26 and July 3, 2006 minutes as presented.  Motion carried 3-0.

Dunkel/Enabnit moved to approve the following claims:  County #1-120, Secondary Roads #18370-18399, and MH-DD #56664-56687.  Motion carried 3-0.

Art White, Dan Squier and Bruce White, representatives of the Veteran’s Memorial Committee, presented their proposal of the design of the memorial for the front lawn of the courthouse property.  Dunkel/Enabnit moved to approve the placement of the proposed design in front of the main entrance of the courthouse and the county agrees to provide grounds maintenance and illumination for the memorial.  Motion carried 3-0.

Tom Keiser, Dan Squier, Larry and Nelda Frahm presented information regarding their objections to having the power line route on 195th St. and asked for the support of the Supervisors to act as spokesmen on their behalf to MidAmerican Energy. The Supervisors suggested the people living in this area start a petition and present it to MidAmerican Energy as soon as possible.

The public hearing for the SW Development Park 1st Subdivision was opened at 10 a.m.  There were no written or oral objections or comments presented prior to the hearing.  The Board and attendees discussed the issue.  The hearing was closed at 10:04 a.m.

Dunkel/Enabnit moved to approve the Quit Claim deed from Floyd County to Winnebago Industries, Inc. for Lot 7, Southwest Development Park First Subdivision now incorporated in and a part of Charles City, Iowa.  Motion carried 3-0.

Enabnit/Dunkel moved to approve the Application for Floyd County License (Fireworks Permit) for Janet Willert for display in August 2006.  Motion carried 3-0.

Enabnit/Dunkel moved to approve the cancellations and Applications for Military Exemptions and Applications for Homestead Tax Credit at the recommendation of the County Assessor.  Motion carried 3-0.

Dunkel/Enabnit moved to appoint Leo Staudt to the FMC Empowerment Board until another permanent elected official or citizen representing Floyd County is selected and can be appointed.  Motion carried 3-0.

Dunkel/Enabnit moved to table an appointment of an alternate to the NIHRA Board.  Motion carried 3-0.

Enabnit/Dunkel moved to send a letter to the Teen Center Board of the County’s interest in the Teen Center building but not at the price they are asking, especially when the County made improvements to the building with grant money.  Motion carried 3-0.

Supv Dunkel updated the Board on Mike Wendel, Chief of Police, being unsuccessful with trying to get someone from Qwest to respond to his request to address the cable cut on June 26.  Supv. Dunkel will write a letter asking for response from Qwest and US Cellular in person or by letter by August 17 addressing the County’s concerns of equipment and planning that the City and County have done to provide emergency services and were found to be defenseless on June 26.  This issue will be addressed by the Communications Board at their August 17 meeting.

The public hearing regarding North Iowa Diesel, Richard Kleinschmidt, to rezone property located in Sec 12, Twp 94N, Rge 15W from Agricultural to Light Industrial opened at 10:30 a.m.  Jeff Sherman, Zoning Director, reported he received no written or oral objects on this issue and that the Zoning Commission approved the rezoning at their meeting today at 9 a.m.  Tom Kleinschmidt spoke of the DOT’s approval to put in a drive and the need for expanding his business to this location.  The hearing was closed at 10:35 a.m.

Enabnit/Dunkel moved to approve the rezoning of property located in Sec 12, Twp 94N, Rge 15W from Agriculture to Light Industrial for North Iowa Diesel, Richard Kleinschmidt.  Motion carried 3-0.

Dusten Rolando, County Engineer, reported that the contract for rock surfacing is done and updated the Board on other activities.  Rolando will follow up on a couple of road and bridge issues brought up by the Board.  Rolando will have the Supervisor’s signatures on permits from now on.  Rolando researched property on Rotary Park Road and found it to be purchased by easement, not by deed title.  In that case, if the county vacated the property, it would go back to the property owner at the time of the easement and would not be the County’s property to sell.  Rolando does like to have areas throughout the County to place materials for jobs and this location would be good for this situations.

Russel Strawn inquired about the County Infrastructure Assistance Program and was instructed to contact Tim Fox, Area Development Corporation for more information.

A motion was made by Supervisor Enabnit and seconded by Supervisor Dunkel to adjourn.  Motion carried 3-0.
