Floyd County Board of Supervisors Meeting

UNAPPROVED MINUTES

The Floyd County Board of Supervisors met for regular session at 9:00 a.m. on Tuesday, September 12, 2006 in the Board Room of the Floyd County Courthouse with the following in attendance:  Chairman Staudt, Supv. Dunkel and Supv. Enabnit.

Dunkel/Enabnit moved to amend the agenda to include noting a wage increase for a Home Health Aide.  Motion carried 3-0.  Enabnit/Dunkel moved to approve the agenda as amended.  Motion carried 3-0.

Dunkel/Enabnit moved to approve the August 21, 22 and 28, 2006 minutes.  Motion carried 3-0.

Enabnit/Dunkel moved to approve the following claims:  County #564-785, Secondary Roads #18498-18549, and MH-DD #56735-56762.  Motion carried 3-0.

Dunkel/Enabnit moved to appoint Florence Shook as al alternate to the NIRHA Board, replacing Keith Oldham.  Motion carried 3-0.

Three bids were received for the 1995 Buick and one bid for the 2001 Ford.  Enabnit/Dunkel moved to accept Clair Rottinghaus’ high bid on the 1995 Buick at $700 and the 2001 Ford at $350.  Motion carried 3-0. 

Staudt/Dunkel moved to give Jeff Sherman, Zoning/911 Addressing/Sanitarian Administrator, a 3% wage increase effective September 15, 2006.  Motion carried 3-0.

Dunkel/Enabnit moved to table any additional building repairs until it can be budgeted for next fiscal year.  Motion carried 3-0. 

Dunkel/Enabnit moved to issue county licenses only required by the Code of Iowa or by County Ordinance.  Motion carried 3-0. 

Enabnit/Dunkel moved to table setting a hearing for the City of Charles City’s proposed Lease Agreement with Option to Purchase the 2nd Street.  Motion carried 3-0. 

Dunkel/Staudt moved to accept the Amendment to Agreement Establishing North Cedar Aviation Authority and authorize Supervisor Enabnit to sign the agreement.  Motion carried 3-0.

Enabnit/Dunkel moved to pay the cost of health insurance up to $547, equivalent to the County’s single health insurance rate, for an employee who was declined insurance due to an untimely enrollment in the plan.  Motion carried 3-0.

Dunkel/Enabnit moved to not waive the GIS website fee for the Iowa Department of Revenue and Finance.  Motion carried 3-0. 

Enabnit/Dunkel moved to canvass votes for the school election on Friday, September 15 at 12:00 p.m.  Motion carried 3-0.

The Board noted a wage increase from $9.40 to $9.88 for Mary O’Connell after completion of the required hours and effective for the pay period ending September 22, 2006. 

The public hearing regarding the proposed Floyd County UR-1 Urban Revitalization Plan was announced and opened at 10:01 a.m.  There were no written or oral objections or comments received.  The hearing closed at 10:03 a.m.  Enabnit/Dunkel moved to approve Resolution #26-06 Finding Need for Establishment of An Urban Revitalization District.  Motion carried 3-0. 

The public hearing regarding the Expanded Urban Renewal Area Designation and Urban Renewal Plan Amendment was announced and opened at 10:15 a.m.  There were no written or oral objections or comments received.  Tracy Meise, City of Charles City representative, provided a map of the area and reviewed the legal description.  The hearing was closed at 10:30 a.m.  Dunkel/Enabnit moved to approve the 2006 Addition to the Southwest Bypass Tax Increment Financing District and authorize the chairman to sign Resolution #24-06 to declare necessity and establish an urban renewal area, pursuant to Section 403.4 of the Code of Iowa and approve urban renewal plan amendment for the 2006 Addition to the Southwest Bypass Tax Increment Financing District.  Motion carried 3-0.

The public hearing regarding the VeraSun Water Main Extension for the Water System Improvements – Equipment Procurement and Waterline Construction Project was announced and opened at 10:25 a.m.  There were no written or oral comments received.  The hearing closed at 10:26 a.m.  No action needs to be taken.

The public hearing regarding action on entering into a lease-purchase agreement in a principal amount not to exceed $2,272,500 payable from incremental property tax revenues to be derived from the Southwest Bypass Tax Increment Financing District was announced and opened at 10:31 a.m.  There were no written or oral objections or comments received.  The Board discussed sections of the Lease Purchase Agreement between VeraSun, the City of Charles City and Floyd County.  The hearing was closed at 10:35 a.m.  Dunkel/Enabnit moved to approve Resolution #25-06 taking additional action with respect to a Lease-Purchase Agreement.  Motion carried 3-0.  Enabnit/Dunkel moved to enter into the Lease Purchase Agreement Between VeraSun, Charles City, LLC as Lessor and The City of Charles City, Iowa and Floyd County, Iowa as Lessees.  Motion carried 3-0. 

Dusten Rolando, County Engineer, provided the Board with Foreman’s minutes.  Rolando updated the Board on the lawsuit between Washington County and IC&E Railroad.  The judge ruled in favor of the County and the railroad was basically told they need to follow the rules for maintaining railroads in the Code of Iowa.  There may be appeals made by the railroad.  The engineering costs for the viaduct project will be paid today.  The RISE project is progressing with the asphalt being milled off, pushing dirt, putting down modified sub-base, and paving around the end of October.  The Board and Rolando discussed the Ulster Township building.  The 110th Street bridge was discussed.  Rolando stands by his original recommendation to close the bridge with the exception to bicycles and pedestrians.  Rolando suggests that a feasibility study for a bridge replacement be conducted and that it be put in the County’s 5-year program. 

A motion was made by Supervisor Enabnit and seconded by Supervisor Dunkel to adjourn.  Motion carried 3-0.
