Floyd County Board of Supervisors Workshop Meeting

 

UNAPPROVED MINUTES

 

The Floyd County Board of Supervisors met for workshop meeting at 9:00 a.m. on Monday, August 15, 2005 in the Boardroom of the Floyd County Courthouse with the following members in attendance:  Chairman Enabnit and Supv. Staudt Absent:  Supv. Dunkel.

Staudt/Enabnit moved to approve the agenda as presented.  Motion carried 2-0.

Doug Schroeder, Conservation Director, presented concerns regarding Weed Commission responsibilities.  We currently handle weed problems by complaint.  Doug asked the board to determine whether they want to address weeds by complaint or to be proactive and budget money accordingly.  The Conservation Department can file a plan for money through an Iowa DOT program called IRVM with the Living Roadway Trust Fund (LRTF) if the Board would like. With active IRVM techniques, we may be able to cut down on contract spraying by planting problem areas with native seeds.  Doug believes the IRVM program along with the Weed Commissioner responsibilities would work well together.  Doug and the County Engineer are working together now to improve communication with Conservation and Secondary Roads.  This will be added to the August 23 agenda.

Marilyn Dettmer, County Attorney, reported that she and Andy Anderson, Iowa Attorney for VeraSun, have reviewed the lease agreement between Floyd County and Bill Vorhes.  The provisions donít apply for legal entry before the 1st of March.  They did look at Clause 11, Landlordís Right of Entry and Inspection, which is set out for purposes of when a landlord has changed tenants, allowing for entry for viewing, seeding or making repairs or for any other reasonable purpose.  There are no legal opinions on ďreasonable purposes.Ē  Mr. Andersonís clients still want to enter the land immediately.  They are asking if the county would consider allowing them in doing so if VeraSun would indemnify the county of damages. There could possibly be a good argument to get on the property after Mr. Vorhes has harvested the crop.  VeraSun will provide a proposal for indemnifying the county of damages if they would consider this option for immediate entry.  The Board would like to discuss the option at the August 23 Board of Supervisorís meeting.

The Board noted the hiring of Audrey Sansgard as RN beginning at $18 per hour with Floyd County Public Health/Home Health Care pending background checks.

The Board noted the fees collected by the Clerk of Court for the month of July in the amount of $608.94 for Sheriff, $275.25 for Sheriff Surcharge and $549.92 for Treasurer.

The Board discussed the Health/Zoning Director, Mike Milliganís vacation and comp time hours.  Mike believes he can have all the hours used up by the end of the year.

The Auditor received information from David Vestal, ISAC attorney, regarding the number of official newspapers the County needs to use.  Floyd County falls under Code 349.3(4) which requires three newspapers but since we only have two newspapers in the county, we have to publish in two.

No future agenda items were reported.

A motion was made by Supervisor Staudt and seconded by Supervisor Enabnit to adjourn.  Motion carried 2-0.

Floyd County Board of Supervisors Special Meeting

 

UNAPPROVED MINUTES

 

The Floyd County Board of Supervisors met for special meeting at 10:30 a.m. on Monday, August 15, 2005 in the Boardroom of the Floyd County Courthouse with the following members in attendance:  Chairman Enabnit and Supv. Staudt Absent:  Supv. Dunkel.

Staudt/Enabnit moved to approve the agenda as presented.  Motion carried 2-0.

Zoning Director, Mike Milligan, presented the preliminary plat for Lake View Estates by Russell and Joyce Strawn and requested to set a hearing for approval of the preliminary plat.  Staudt/Enabnit moved to set hearing for September 12, 2005 at 10:30 a.m.  Motion carried 2-0.

A motion was made by Supervisor Staudt and seconded by Supervisor Enabnit to adjourn.  Motion carried 2-0.
