Floyd County Board of Supervisors Meeting

August 25, 2009, 9:00 AM


The Floyd County Board of Supervisors met for regular session at 9:00 a.m. on Tuesday, August 25, 2009 in the Board Room of the Floyd County Courthouse with the following in attendance:  Chairman Staudt, Supv. Dunkel, Supv. Enabnit.

Dunkel/Enabnit moved to add review/action regarding resolution on Central Iowa Juvenile Detention Center.  Motion carried 3-0.  Enabnit/Dunkel moved to approve the agenda as amended.  Motion carried 3-0. 

Dunkel/Enabnit moved to approve the August 10, 11 and 17, 2009 minutes.  Motion carried 3-0.

Enabnit/Dunkel moved to approve the following claims:  County #439-574, Secondary Roads #11878-11915 and MH-DD #58640-58662.  Motion carried 3-0. 

Justin Cornish, Central Iowa Juvenile Detention Center, informed the Board that Article VIII Section 4d of the 28E that refers to termination and debt will be removed from the revised 28E agreement and the corresponding section in the bylaws.  Cornish informed the Board that after CIJDC receives the state grant in September, Floyd County would be joining with $5,000 in debt and $83,000 in equity.  The remaining CIJDC debt will be approximately $300,000 after they receive that check.  Dunkel/Staudt moved to approve Resolution #23-09 Central Iowa Juvenile Detention Center 28E.  Motion carried 3-0.  The Board requested that Cornish provide the Board with current financials, proof of state revenue received and outstanding loan balance. The CIJDC Commission can act on Floyd County joining at Thursday’s Commission meeting.  Dunkel/Staudt moved to appoint Arlin Enabnit as a Commissioner if Floyd County is approved to join Central Iowa Juvenile Detention Center.  Dunkel/Enabnit moved to appoint Leo Staudt as an alternate to Central Iowa Juvenile Detention Center.  Motion carried 3-0. 

Enabnit/Dunkel moved to set an inspection rate $125 for holding tank septic systems effective today.  Motion carried 3-0.

Dunkel/Enabnit moved to authorize the chairman to sign the Medicare Enrollment Application adding and deleting members and authorized signature.  Motion carried 3-0. 

Dunkel/Enabnit motioned to authorize the current or future chairpersons to the Floyd County Board of Supervisors to sign any recurring applications or contracts on behalf of the county at his/her discretion.  Motion carried 3-0.

Dunkel/Enabnit moved to approve Richard and April Kleinschmidt’s Application for Tax Exemption within the Urban Revitalization plan of Floyd County with respect to North Iowa Diesel located at 31324 Floyd Line Street, Nashua Iowa 50658 with a projected budget of $630,500.  Motion carried 3-0. 

Enabnit/Dunkel moved to approve Contract #08-DRMH-012 Iowa Department of Economic Development Community Development Block Grant (CDBG) Hazard Mitigation Grant Program Match for Property Acquisition Contract for an award amount of $24,009.  Motion carried 3-0.

Dunkel/Enabnit moved to approve the Floyd County 2010 Orthophotography contract for Dan Corbin, Inc.photogrammetric consulting services of new aerials.  Motion carried 3-0.  

Enabnit/Dunkel moved to table waiving GIS fees for shape files for an Ohio State University nationwide research project on land use and land values spearheaded by the Economic Research Service, an agency within the US Department of Agriculture until the Auditor can gather more information.  Motion carried 3-0.

Supv Staudt informed Dusten Rolando, County Engineer, about a complaint on Mennonite buggy lug and bar wheels causing ruts on roads.  Rolando will check the code but enforcement of any issues would be up to the Sheriff’s Department.  Rolando reported that the B60 bridge approach is completed.  The viaduct erosion problem is corrected and seeding is finished.  Staff is working on wrapping up paperwork on projects.  Supv Dunkel informed Rolando about a resident on the Colwell road who thinks the location of his mail box and the slope to the new road could be a problem in the winter.  Chickasaw and Floyd County and Charles City will split the cost of a Durapatch machine.  A thank you note from a resident near the 100th St bridge was read.  Staff will be working on some day labor projects for next year.  The Catt House road will be put off until next year and the Foothill culvert will be done first.  A bridge on Jersey will be looked at.  Rolando informed the Board of permission that he gave Erwin Johnson to place concrete where there are some scouring problems.  Secondary Roads will shape up the area make sure the concrete is placed where it needs to be.   

The Board inquired with the Auditor on the Vorhes and Zwanziger lawsuits.  The Auditor said EMC’s attorney has asked for any scheduling conflicts the supervisors may have for mid to late 2010 so the attorneys and judges can eliminate those dates when they conduct a conference call to schedule a date for the Vorhes trial.   Supv Staudt informed the board that the footings are being poured for the new concrete structure on the Gerhard property and that Mike Staudt has visited with all the property owners about the structure including the cost.  The Zwanziger trial is scheduled for September 22 in Allison. 

A motion was made by Supervisor Enabnit and seconded by Supervisor Dunkel to adjourn.  Motion carried 3-0.
