Floyd County Board of Supervisors Meeting

UNAPPROVED MINUTES

The Floyd County Board of Supervisors met for regular session at 9:00 a.m. on Tuesday, May 24, 2011 in the Board Room of the Floyd County Courthouse with the following in attendance:  Chairman Dunkel, Supv. Kamm, and Supv. Kuhn.

Kamm/Kuhn moved to approve the agenda as presented.  Motion carried 3-0. 

Public Comment:  None.

Kamm/Kuhn moved to approve minutes for May 9, 10, and 16, 2011 as presented.  Motion carried 3-0.

Kamm/Kuhn moved to approve the following claims:  County #3255-3399, Secondary Roads #13382-13412, and MH-DD #59356-59365.  Motion carried 3-0. 

Tim Fox, Charles City Area Development Executive Director, explained the purpose of the Development Agreement between Floyd County, the City of Charles City and Mitas Tires North America, Inc. The agreement provides $2,700,000 in financial incentives for a 9-year period covered by tax increment payments.  Covenants by the Company and the County were discussed.  Kuhn/Kamm moved to approve the Development Agreement between Floyd County, the City of Charles City and Mitas Tires North America, Inc.  Motion carried 3-0. 

Fox reviewed the requirements of a loan agreement with the Southwest Bypass Tax Increment Financing District and Mitas Tires North America, including an average of 154 jobs with an average wage of $13.03/hour in return for a forgivable note.  Fox stated that in a previous Southwest Bypass TIF District meeting, the loan was approved.  Kamm/Kuhn move approve the $192,500 loan agreement and authorize Doug Kamm, chair of the Southwest Bypass Tax Increment Financing District board, to sign the contract between the Southwest Bypass Tax Increment Financing District and Mitas Tires North America.  Motion carried 3-0.  

Fox explained a resolution to make changes to enterprise zone areas which relocates EZ-6, Woodland Acres, to Floyd County, EZ-20A, Jefferson School.  Fox commented that the enterprise zone area is for housing zone purposes, not industrial uses.  Kamm/Kuhn moved to approve Res #12-11 Resolution approving petition by Floyd County, Iowa to the Iowa Department of Economic Development requesting relocation of Floyd County, Floyd EZ-6 situated with unincorporated Floyd County, Iowa to that portion of Charles City, Floyd County, Iowa specified within the resolution. Motion carried 3-0.

The Auditor informed the Board that although several notices were mailed out in addition to publication in the newspaper, a letter from the State Auditorís office was received declining bidding on three fiscal years of Floyd County audits due to the state not being in a position to commit resources due to the number of audits already planned and Gardiner Thomsen was the only bidder.  Kuhn/Kamm moved to approve the Request for Proposal for Audit Services from Gardiner Thomsen for a fee of $25,000 for FY11, $26,000 for FY12 and $27,000 for FY13.  Motion carried 3-0.

The Board opened the public hearing regarding the Floyd County FY11 Budget Amendment at 9:27 a.m.  The Auditor received no written or oral objections or comments prior to the hearing.  The amendment mainly includes paying off a $1,335,000 bond early, not paying off a $513,000 bond until next fiscal year and reducing the expected payout on road projects which will be completed in FY12 instead of FY11.  The hearing closed at 9:32.  Kuhn/Kamm moved to approve the FY11 budget amendment and approve Resolution 13-11 Appropriation Changes for the FY11 budget.  Motion carried 3-0.

Kamm/Kuhn moved to approve Res 14-11 Interfund Loan transferring $66,434.81 from the General Basic Fund to the Debt Service Fund only if the Build America Bond 35% Return for Credit Payment from the Internal Revenue Service for the General Obligation Taxable Urban Renewal County Road Improvement Bonds, Series 10A is not received by June 1, 2011.  Motion carried 3-0.

Kamm/Kuhn moved to approve the Application for Use of Floyd County Courthouse Grounds from the Patriotic Committee on May 30, 2011 for the Veterans Memorial.  Motion carried 3-0.

Kuhn/Kamm moved to approve the Fiscal Agent Agreement FMC Community Empowerment/Early Childhood Iowa/Floyd County.  Motion carried 3-0.

Kuhn/Kamm moved to approve the Nationwide Retirement Solutions Plan Sponsor Signature Page for plan document changes and continuing the Nationwide ProAccount services.  Motion carried 3-0.

Kamm/Kuhn moved to approve an Underground Construction Application for Qwest for buried cable on 110th St. and Shadow Ave.  Motion carried 3-0.

Dusten Rolando, County Engineer, updated the Board on various projects.  Contractors are finishing up shouldering work on the Dougherty road project.  Construction will start soon on T-38.  Pavement markings are completed.  Contract rock should start around June 13.  Contractors have been working on dust control.  Crews have been working on minor drainage district repairs.  B57 work will be starting next Tuesday.  Some of the asphalt has been milled at the T24 railroad crossing west of Rudd but there is still a bad rail which the railroad is scheduled to fix in 2013.  The claim for hearing exams for Secondary Road, certain County Engineering staff and Conservation staff was discussed. 

Rolando provided a list of civil engineers for drainage district work.  The Auditor commented she visited with Cerro Gordo County about the problems with the shared DD#6/DD #56 and is waiting to hear back on a date for a joint meeting.  The Auditor left a message with the civil engineer Cerro Gordo County uses to see if he was interested in meeting with the Board to discuss DD #12 and is waiting for a return call.  DD #12 property owners have been notified of the June 14 meeting. 

A motion was made by Supervisor Kuhn and seconded by Supervisor Kamm to adjourn.  Motion carried 3-0.
