Floyd County Board of Supervisors Meeting

The Floyd County Board of Supervisors met for special session at 9:00 a.m. on Monday, December 23, 2011 in the Board Room of the Floyd County Courthouse with the following in attendance: Chairman Dunkel, Supv Kamm, and Supv. Kuhn.
Kuhn/Dunkel moved to approve the agenda as presented. Motion carried 2-0.
The Board recessed until 9:30 until Supv Kamm arrived at the meeting.
The Board discussed suggested additional changes to the proposed Zoning Ordinance including: 1) The definition of Agriculture was proposed to include “aquaculture” and two sentences were added. 2) Building permits and zoning certificates were identified as being synonymous. 3) Replacing “gas” with “service” in the definition of “Service Station”. 4) Revising the definition of “Special Events” by moving the reference to “200 persons” to the first part of the definition and revising regularly scheduled events and auctions on properties other than auction houses or commercial sale yards. 5) Adding to the definition of “Structure” to “Among other things, fence, fence posts, and flag poles are not considered structures”. 6) Adding “Auction Houses and Commercial Sale Yards” to ‘A’ and ‘C-1’ districts. 7) Reducing lot areas from 15 to 10 acres for nurseries and greenhouses, orchards and tree farms. 8) adding “Kennel, Dog (private)” to the list of Conditional Uses for ‘R-1’ and ‘R-2’ districts. 9) adding “Residential Correctional Facilities” to the list of Conditional Uses for ‘I-2’ districts. 10) Revising Section XVII.M Flood Plain Conservation Overlay District ‘F-C’, Penalties references imprisonment which conflicts with the previously amended Section XXIV Violation and Penalty and it was suggested to except out the violations of the flood plain requirements in Section XXIV to allow stricter violations. 11) Minor technical changes. Discussion included whether or not the Supervisors should have authority to act should the Zoning Commission not consider a citizen’s petition. Reference was made to a recent petition signed by citizens requesting the Board not pass the proposed zoning ordinance. Supv Kuhn will visit with the County Attorney about this issue. Supv Kuhn commented that no proposals were written to change lot size for 10 acres to include the road right of way; the proposed ordinance reads to exclude the right of way.
Kuhn/Kamm motioned to adjourn. Motion carried 3-0.
