Minutes of Board of Zoning Hearing for Robert Engels to rezone 3.85 acres of property located at 1950 – 230th Street in the NW¼ and the NE¼ of Section 27-T95N-R17W, Floyd County, Iowa, from AG to R-1.
The Board opened the meeting with the introduction of the new Board member, Michael Goddard, and was followed by the election of officers.Motion to appoint Thomas Schwab as Chair was made by Susan Nelson and was seconded by Michael Goddard.Motion to appoint Susan Nelson as Co-Chair was made by Thomas Schwab and seconded by Duane Koch.Roll call vote was taken and the appointments were unanimously approved.Board member Dean Tjaden was absent for the election of officers.
Board members present were Thomas Schwab, Susan Nelson, Duane Koch, Dean Tjaden, and Michael Goddard.Also present was Jeff Sherman-Administrator.Roll call of Board members was taken and four (4) of the (5) members were present, with Board member Dean Tjaden arriving after roll call.
Robert Engels’ application comes before the Board for a hearing to rezone 3.85 acres of property located at 1950 – 230th Street in the NW¼ and the NE¼ of Section 27-T95N-R17W, Floyd County, Iowa, from AG to R-1for the purpose of splitting the acreage lot from the farmland in order to sell same.Board member Thomas Schwab brought it to the Boards’ attention that he spoke to the applicant the previous Friday concerning questions he had about the Plat of Survey that was submitted with the Petition to Rezone.The Plat of Survey is the Survey of the original fifteen (15) acres and it does not show the 3.85 acre split.It was determined, after speaking with the Auditor and Recorder, that the proposed Warranty Deed that will convey the West Three Hundred Ninety Feet of a parcel of land designated as Parcel “A” sufficiently shows the 3.85 acres and that neither Department would require a separate Survey of the 3.85 acres in order to approve the conveyance.It was also determined that the splitting of the acreage lot from the farmland would constitute a second split in regards to the County’s Subdivision requirements.Applicant Engels was present for the Hearing and stated that he intended to split the acreage lot from the farmland to sell to his daughter and son-in-law.Applicant Engels’ son-in-law, Russ Lyman, was also present for the hearing. Discussion was had concerning the location of the East boarder of the original fifteen (15) acres.Discussion was also had concerning the zoning checklist.It was determined that the checklist had been completed.Board member Thomas Schwab advised the applicant and the buyer that if they were to split either of the remaining parcels one more time, they would be subject to Subdivision requirements.
There were no additional parties present or any letters in support of or against the zoning change.
A motion was made to approve the application to rezone 3.85 acres of property located at 1950 – 230th Street in the NW¼ and the NE¼ of Section 27-T95N-R17W, Floyd County, Iowa, from AG to R-1 for the purpose of splitting the acreage lot from the farmland by Dean Tjaden and was seconded by Duane Koch.Roll call vote was taken and the application was unanimously approved.

Administrator Jeff Sherman updated the Board regarding the budget.As of this date, the Board of Supervisors have approved a $20,000.00 budget for updating our Zoning Ordinance, which we may be able to get started on as soon as July.It is anticipated that we will use $10,000.00 for the Ordinance and $10,000.00 for the comp plan.It is also anticipated that this will be a two (2) year process and we may add more to our budget the next fiscal year if need be.Board member Thomas Schwab wanted to go on the record by stating that the Administrator, Jeff Sherman, and his assistant, Misty Norton, have done an excellent job in updating and coming up with new forms for the office.Discussion was also held concerning our zoning map.Administrator Jeff Sherman advised the Board that the County’s zoning is now on our GIS map and that the next step is to get that GIS map approved as our official zoning map.Administrator Sherman needs to do some more checking as to how to go about getting the GIS map approved as our official map.Discussion was also held concerning the checklist.The Board wanted to know if they can assume that the zoning checklist has been completed prior to each and every hearing.It was determined that it would be, as the checklist is the first thing the Department’s staff pulls out when a zoning change is being requested.The Board members were also given two (2) Zoning Hearing Procedures and a Land Division Review Form to approve.After reviewing same, it was determined that one of the two procedures was for the applicant and the other was for the office.The Board members unanimously approved the Zoning Hearing Procedures and the Land Division Review Form.The Board suggested that prior to updating our zoning ordinance, we may want to put a notice out to our local attorneys, realtors, etc. for suggestions on things that do and do not work.They also suggested creating new binders for the zoning ordinance as the current binders are in pretty rough shape.Administrator Sherman advised the Board of the upcoming zoning hearings on March 10, 2009, at
