Minutes of Board of Zoning Hearing for Richard & Terry Bohr to rezone 3.00 acres of property located at 1064 Hickory Avenue in the Southwest Quarter of Section 20, Township 97 North, Range 17 West, Rudd Township, Floyd County, Iowa, from AG to R-1.
Board members present were Thomas Schwab, Susan Nelson, Dean Tjaden, and Michael Goddard. Also present was Jeff Sherman-Administrator. Roll call of Board members was taken and four (4) of the (5) members were present, with Board member Duane Koch being absent.
Applicant Richard Bohr was present for the hearing and stated that there is an old existing house on the property that is in pretty rough shape. They would like to keep the garage and put a new 28’ x 76’, ranch style – manufactured home just South of the garage with an ICF foam basement. Discussion was had concerning the garage. It was determined that it will be a detached garage with a breezeway between the garage and house. Discussion was also had concerning the location of the property. Discussion was had concerning the rezoning of the property. Board Member Dean Tjaden inquired as to why the property had to be rezoned just to build a new house. It was determined that the lot size is less than ten (10) acres and needs to be rezoned to R-1. Discussion was held concerning the existing home. It was determined that the existing house would be torn down and either hauled away or burned. Administrator Jeff Sherman advised applicant Bohr that he can not burn the shingles; they will have to be hauled away.
There were no additional parties present in support of or against the zoning change. There were three (3) letters received by the Zoning Department in support of the zoning change and a call from one lady who wanted the applicants to be aware of a dust control policy in the country, but who had no objections.
A motion was made to approve the application to rezone 3.00 acres of property located at 1064 Hickory Avenue in the Southwest Quarter of Section 20, Township 97 North, Range 17 West, Rudd Township, Floyd County, Iowa, from AG to R-1 for the purpose of building a new home by Susan Nelson and was seconded by Dean Tjaden. Roll call vote was taken and the application was unanimously approved.

Administrator Jeff Sherman updated the Board concerning the Supervisors’ approval of the NIACOG Agreement for the zoning ordinance update. Discussion was had concerning whether there would be some evening meetings to work on the ordinance and it was determined that there would be two (2) or three (3) meetings that we would be scheduling in the near future. Board Members Thomas Schwab and Susan Nelson would like to participate and be involved in the ordinance update. Administrator Jeff Sherman also advised the Board of an upcoming COZO Conference that he and his assistant, Misty Norton, would be attending in Ames on April 29th through May 1st, 2009.
