          Minutes of Board of Adjustment’s Hearing held on June 21, 2011.

 

I.                   Call to Order.  Meeting was called to order at 9:00 a.m. Board members present were John Gohr, Ron Muff, Dennis Staudt, and Ann Sullivan.  Also present was Jeff Sherman, Zoning Administrator.  Roll call of Board members was taken and four (4) of the (5) members were present with Bill Fluhrer being absent.

 

II.                Approval of Agenda.              A motion to approve the agenda as presented was made by John Gohr and seconded by Ron Muff, motion was unanimously approved. 

 

III.             Approval of Minutes.  A motion to approve the minutes from the May 17, 2011, meeting was made by Ron Muff and seconded by John Gohr, motion was unanimously approved. 

 

IV.             Communications Received.  No Communications received.

 

V.                Old Business.  Chair Ann Sullivan signed the Board of Adjustment Rules of Procedure approved at the last meeting.

 

VI.             New Business.

 

A.    A conditional use request by Titus & Mary Stauffer to have an existing greenhouse on their property located at 1120 Underwood Avenue in the NW¼ of Section 28, Township 97 North, Range 15 West of the 5th P.M., Cedar Township, Floyd County, Iowa.  Mr. Titus Stauffer was present for the hearing.  Applicant Stauffer stated that he is asking for permission to continue running his greenhouse on the subject property.  Chair Ann Sullivan inquired as to whether the applicants would be expanding their operation.  Applicant Stauffer stated that he was not expanding, he just was not aware that he needed a permit before opening up the business.  Member John Gohr inquired as to how many structures were being used.  It was determined that there were a few small greenhouses located on the property.

 

Member Gohr inquired as to whether any complaints had been received by the Planning & Zoning Department.  Administrator Sherman stated that the Department did receive a call from David Kuhn who inquired about the location of the greenhouse and expressed concerns over the well and the water usage by the greenhouse operation.  Administrator Sherman stated that he did not think this would be a problem.  Applicant Stauffer added that the well is also inspected regularly because of the dairy.  No other letters or calls in support of or against this conditional use request were received by the Planning & Zoning Department. 

 

A motion to approve the conditional use request made by Titus & Mary Stauffer to have an existing greenhouse on their property located at 1120 Underwood Avenue in the NW¼ of Section 28, Township 97 North, Range 15 West of the 5th P.M., Cedar Township, Floyd County, Iowa, was made by John Gohr and was seconded by Ron Muff.  Roll call vote was taken and the application was unanimously approved.

 

B.     A conditional use request by Lloyd & Elaine Nolt to have an existing greenhouse on their property located at 3361 – 165th Street in the NE¼ of Section 24, Township 96 North, Range 15 West of the 5th P.M., Niles Township, Floyd County, Iowa.  Mr. Lloyd Nolt was present for the hearing.  Applicant Nolt stated that they have three (3) greenhouses on the subject property, all different sizes.  They sell flowers and produce and they just started retailing this year.  Mr. Nolt stated that he was also unaware he needed a permit before opening the business.

 

 

Member Gohr inquired as to whether any comments had been received by the Planning & Zoning Department.  Administrator Sherman stated that no letters or calls in support of or against this conditional use request were received by the Planning & Zoning Department. 

 

A motion to approve the conditional use request made by Lloyd & Elaine Nolt to have an existing greenhouse on their property located at 3361 – 165th Street in the NE¼ of Section 24, Township 96 North, Range 15 West of the 5th P.M., Niles Township, Floyd County, Iowa, was made by Dennis Staudt and was seconded by John Gohr.  Roll call vote was taken and the application was unanimously approved.

 

 

VII.          Adjourn.  Motion to close the hearing was made by Ron Muff and was seconded by Dennis Staudt.
