Minutes of Board of Adjustment’s Hearing held on September 18, 2012.
I. Call to Order. Meeting was called to order at 9:05 a.m. Board members present were John Gohr, Dennis Staudt, Bill Fluhrer, Ann Sullivan, and Angela Ruzicka. Also present were Jeff Sherman, Zoning Administrator, Roll call of Board members was taken and Five (5) out of five (5) members were present.
II. Approval of Agenda. A motion to approve the agenda as presented was made by John Gohr and seconded by Bill Fluhrer, motion was unanimously approved.
III. Approval of Minutes. A motion to approve the minutes from the August 29, 2012 meetings was made by Dennis Staudt and seconded by Angela Ruzicka, motion was unanimously approved.
IV. Old Business. No old business.
V. New Business.
A. A variance request by Chad Kober to build an attached garage 10 ft from edge of road rather than 25ft from the Right of way that is required on his property specifically located at 1868 Riverview Dr. in Section 35, township 96 North, Range 16 West of the 5th P.M., St. Charles Township. Applicant Chad Kober was present for the hearing. Mr. Kober stated that he would like to build a double attached garage 24x22 10 ft to the property line. Mr. Sherman did recived an Email for the owner of the private drive Rodney & Brandy Schmidt, the only concern they had was about snow removal and they had worked this out between themselves. Mr. Sherman had also talked to Brandy Schmidt this morning after Mr. Sherman had been out to the property this morning to take a second look at the property lines. Brandy Schmidt said she still had no issues with the request. Mr. Sherman enters the staff report in to the hearing. Mr. Sherman also mentioned that he had talked to the County Engineer; he said it was a privet drive and would remain a private drive do to the way it was constructed and would not be able to meet county specs so he had no issues with the request. Bill Fluhrer questioned who owed the road, it was determined it belong to the Schmidt who also the owners of the adjacent field to the road. John Gohr commented that there are leach fields in the field next to the road. Mr. Sherman said that they have easements to have their leach field there. There were no oppositions to the variance.
A motion to approve the variance request by Chad Kober to build an attached garage 10 ft from edge of road rather than 25ft from the Right of way that is required on his property specifically located at 1868 Riverview Dr. in Section 35, township 96 North, Range 16 West of the 5th P.M., St. Charles Township. Was made by John Gohr and seconded by Dennis Staudt. Roll call vote was taken and the motion was unanimously approved.
VI. Adjourn. Motion to close the hearing was made by Bill Fluhrer and was seconded by John Gohr.
